Reliance Brands Luxury Fashion Private Limited, having its registered office at 4th Floor, Court House, Lokmanya Tilak Marg, Dhobi Talao, Mumbai, Maharashtra - 400002, India (“Reliance”, “we”, “us” or “our”) is managing and operating the website www.tumi.in (“Website”), through which it inter alia facilitates the sale of high end suitcases, travel bags and such other products (“Product”), sold under the brand name ‘TUMI’ (“TUMI”) to the users of the Website (“User” or “you” or “your”).
TUMI’s comprehensive product coverage is reflective of its commitment to the User’s ongoing satisfaction. Specifically, TUMI makes three commitments to the User’s:
- 1. The User will enjoy using TUMI’s innovative products that are designed and manufactured to be the best;
- 2. The User will experience world-class, after-sales customer services offered by TUMI;
- 3. For five (5) years after the User(s) purchases a Product from the Website, which is offered under TUMI’s travel, business, or bag collections, or two (2) years for any wallet or accessory & outerwear, the User will be covered by TUMI’s limited warranty.
WARRANTY ON FIRST YEAR OF PURCASE
With limited exceptions, if your TUMI Product is damaged during the first twelve (12) months of you purchasing it - including damage caused by normal wear and tear, airline handling, or other transit damage, TUMI shall cover all repair expenses, including shipping costs to and from the TUMI repair facility. If we determine that the product is damaged beyond repair, TUMI shall replace the Product. If TUMI determine that the same Product is not available for replacement, TUMI shall provide you with a Product of comparable value. Damages not covered under this warranty are damage resulting from abuse, cosmetic damage (such as scratched leather or stained fabrics), and incidental or consequential damages, as may be determined by TUMI from time to time.
ADDITIONAL WARRANTY POST FIRST YEAR OF PURCHASE
From the beginning of the second year through the end of the fifth year post purchase of your TUMI travel item, business case or other bag, and for the second year of purchase of wallets, accessories, or outerwear, TUMI will repair any item that is damaged due to normal wear and tear, or defective in materials or workmanship, including any structural defects (such as defective handles, zippers, or locks). For years, two through five, TUMI does not cover damage caused by airlines or other transit damage. Damage claims in transit cases should be filed against the carrier. Other damages not covered are damage resulting from abuse, cosmetic damage (such as scratched leather or stained fabrics) and incidental or consequential damages, as may be determined by TUMI from time to time. Normal wear and tear for TUMI outerwear does not include lost or missing buttons, torn fabrics or leathers or cosmetic damage as may be determined by TUMI from time to time.
We do have many customers with well-travelled bags (i.e., more than five years old), that they would like to have refurbished or repaired. For these customers, we offer courteous, responsive service and the highest quality repairs and refurbishment at a reasonable cost. If we are unable to repair the bag, we will suggest alternative options. PROOF OF PURCHASE
Please save your receipt / retail invoice as proof of purchase. This will be needed to demonstrate your warranty coverage. Additionally, this will serve as proof that your purchase was made at the Website. TUMI’s limited warranty only applies to Products that were purchased from the Website.
Registering with the TUMI Tracer® program records the date of purchase so that your information is in our system. Should you ever need to use our repair services, we can validate if your bag is still under warranty. Not all items we make have a tracer number, but most of our luggage, bags, and business cases do. If the item in question is not registered with TUMI Tracer® it will be your responsibility to provide proof of purchase at an authorized TUMI retailer
The TUMI limited warranty as mentioned in this policy is being offered by TUMI to you. Reliance will not be liable to you and/or TUMI for any matters with respect to the TUMI limited warranty.
TUMI and/or Reliance shall not, under any circumstance, whether as a result of breach of contract or warranty, tort, or otherwise, be liable for any incidental, special or consequential damages, including loss of profits or revenues or any other costs or damages. This Warranty shall not in any manner extend to personal injury and/ or death caused by the User’s own negligence or omissions. To the maximum extent permitted by applicable laws, the remedies in this Warranty are your sole and exclusive remedies and TUMI’s total liability, relating to or arising out of your purchase or use of Product or damage thereto, regardless of the type or cause of such damage or the characterization of the claim asserted (whether in contract or tort), shall not under any circumstances exceed the Product’s purchase price as on the invoice. This Warranty does not cover: (a) minor imperfections in the Product that broadly meet design specifications, or imperfections that do not materially alter the Product’s functionality; and (b) claims arising out of the Product’s dissimilarity with the images appearing on the Website. You are required to satisfy yourself regarding the suitability of the Product before making any purchase. TUMI does not make any representation or warranty as to the suitability of the Product for any particular use. TUMI is not liable to fulfil any responsibility in case of an invalid or wrongful warranty claim. TUMI makes no assurance, representation or warranty that the replaced Product will be identical or similar to the Product you purchased. TUMI reserves the right to be the sole judge as to whether the Product is a damaged Product and its decision in this regard shall be final. TUMI further reserves the right to charge the claimant for any reasonable and applicable costs and expenses (at prevailing rates) relating to or arising out of the repair or replacement of the Product.
GOVERNING LAW AND JURISDICTION
This Warranty Policy shall be governed by laws of India and all claims arising from this warranty policy shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
TUMI and/or Reliance reserves the right to modify or amend the terms and conditions herein due to change(s) in availability of services, products and/ or spare parts or for the purposes of complying with applicable policies, rules, regulations and law, with or without notice.
